Requestor Agreement

1. API Key Responsibility

As a Requestor on the GetABrain.ai platform, you are issued API credentials (an API key and secret) to access our services. You are fully responsible for the security and proper use of these credentials:

• Secure storage: API keys and secrets must be stored securely and never hard-coded in client-side code, public repositories, or any location accessible to unauthorized parties.
• No sharing: You must not share your API credentials with any third party. Each set of credentials is issued to a single Requestor account.
• Rotation upon compromise: If you believe your API credentials have been compromised, you must rotate them immediately through your dashboard and notify us at api@getabrain.ai.
• You are responsible for all activity that occurs under your API credentials, whether or not authorized by you.

2. Content Liability

You are solely responsible for all content submitted through the GetABrain.ai API using your credentials. This includes, but is not limited to, the content of all queries, any attachments or supplemental materials, and any instructions provided to Workers. GetABrain.ai acts solely as an intermediary and does not review, endorse, or assume liability for the content of queries submitted by Requestors.

3. Prohibited Content

You must not submit any of the following through the platform:

• Content that is illegal under any applicable federal, state, or international law.
• Content that promotes violence, exploitation, or harm against any individual or group.
• Content involving child sexual abuse material (CSAM) or any form of child exploitation.
• Content that infringes on the intellectual property rights of any third party.

GetABrain.ai reserves the right to report any illegal content to the appropriate law enforcement authorities. In the event that illegal or confidential content is leaked or disclosed as a result of your submission, GetABrain.ai shall not be held liable for any damages arising from such disclosure.

4. Indemnification

You agree to indemnify, defend, and hold harmless GetABrain.ai, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Any content you submit through the API or the platform.
• Your violation of this Requestor Agreement or the Terms of Service.
• Your violation of any applicable law or regulation.
• Any claim by a third party arising from your use of the Service or the content of your queries.

5. Payment Terms

The GetABrain.ai platform operates on the following payment model:

• Prepaid balance: You must maintain a prepaid balance in your account to submit queries. Your balance is deducted when a query is submitted.
• Platform fee: A 15% platform fee is applied to each query. This fee is included in the total amount deducted from your balance.
• No subscriptions: There are no recurring subscription fees. You only pay for the queries you submit.
• No refund on completed responses: Once a response has been delivered and marked as completed, no refund will be issued for that query.
• Partial refund on cancellations: If you cancel a query before any Worker has submitted a response, you may be eligible for a partial refund of the query cost.

6. Rate Limits & Acceptable Use

To ensure fair access and platform stability, rate limits are applied to all API requests. These limits may vary based on your account tier and usage history. You agree to:

• Respect all rate limits and not attempt to circumvent them through any means.
• Not use the API in a manner that degrades the Service for other users.
• Implement appropriate error handling and exponential backoff in your API integrations.
• Not send duplicate or near-duplicate queries in an attempt to game the system or exploit Workers.

7. Data Handling

By using the GetABrain.ai platform, you acknowledge and agree to the following data handling practices:

• Quality improvement: Responses generated through the platform may be used in anonymized and aggregated form to improve platform quality, calibrate quality scoring systems, and enhance bot detection.
• Confidentiality: The content of your queries is treated as confidential. Workers are bound by confidentiality obligations and are prohibited from sharing, copying, or disclosing query content.

8. Warranties & Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

GetABrain.ai does not guarantee:

• The quality, accuracy, or completeness of any response provided by Workers.
• That responses will be delivered within any specific time frame.
• That the Service will be uninterrupted, error-free, or free from harmful components.
• That any particular number of Workers will be available to respond to your queries.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, GETABRAIN.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, BUSINESS OPPORTUNITIES, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

Our total aggregate liability for any claims arising under this agreement shall not exceed the total amount you have paid to GetABrain.ai in the 12 months preceding the event giving rise to the claim, or $100, whichever is greater.
